General terms of delivery

We apply general terms of delivery. A free copy of these is available on request.

Our general terms of delivery apply to the sale and delivery of products by Vette & Verhaart B.V., Jan Vette B.V. and all associated companies.

A summary of the main conditions follows below. This text also appears on our quotations and on the back of our stationery and invoices.

  • All stated/agreed prices are net prices (i.e. excluding VAT, transport costs, duties and other (tax) levies, unless otherwise agreed).
  • Payment due: 30 days after invoice date.
  • Delivery: unless otherwise agreed, our products are deemed delivered as soon as they have left our factory or our oyster warehouse in Yerseke (NL) (Incoterms 2000 EXW).
  • Risk transfer: at the moment of delivery.
  • Delivery times are only indicative.
  • We sell our products with retention of title. However, resale is permitted.
  • In the event of any shortcoming, a (written) claim must be submitted within 10 days of delivery.
  • We are not liable for trading loss, consequential damage or indirect damage. We are not liable to pay replacement or supplementary compensation, other than in the case of gross negligence or intention. Any compensation due will never be higher than the invoice value of the products which caused the damage, or the amount paid by an insurer with regard to the damage.
  • All agreements are subject to Dutch law.
  • All disputes will be settled by the competent court in Middelburg.
